The Logic of Legal Argumentation: Multi-Modal Perspectives (Law, Language and Communication)

Multi-modal argumentation with its logical, emotional, visceral and kisceral arguments is an important addition to logical argumentation, especially when real-life situations are considered. It does not discard logic but adds other modes of argumentation to complement it, to emphasize the realistic environments of communication. In this sense, the multi-modal theory is important for the area of legal argumentation, where even in the reasoning of judicial decisions traces of a flesh-and-blood personality, who decided the case and wrote the reasons, can be found. This book presents a comprehensive analysis of this informal logic in legal argumentation and its practicality within the law. It argues that by building on the dialectical and rhetorical models of legal argument, the former being important for clear cases while the latter for unclear ones, the multi-modal theory of legal argumentation brings together logic and psychology in a holistic or integral perspective. The approach is not only descriptive, identifying the traces of alternate arguments in judicial decisions, but is also normative, presenting the criteria for evaluation that multi-modal arguments need to face to attain validity in the legal context. The work will be of interest to academics and researchers in the areas of Legal Theory, Legal Linguistics, Philosophy of Law, and Communication Studies.

The Logic of Love in The Canterbury Tales argues that Geoffrey Chaucer’s magnum opus draws inventively on the resources of late medieval logic to conceive of love as an "insoluble." Philosophers of the fourteenth century expended great effort to solve insolubilia, like the notorious Liar paradox, in order to decide upon their truth or falsity. For Chaucer, however, and in keeping with Christ’s admonition from the Sermon on the Mount, the lover does not judge – does not decide on – the beloved. Through a series of detailed and rigorously "non-judgmental" readings, Manish Sharma provides new insight into each of the prologues and tales and intervenes into scholarly debates about their collective import. In so doing, The Logic of Love in The Canterbury Tales deploys Chaucer’s understanding of charity to consider the limitations of modern critical approaches to The Canterbury Tales, including deconstruction, psychoanalysis, and gender theory. In the course of the analysis, Sharma shows not only how love and medieval philosophy together inform Chaucerian composition, but also how Chaucer could serve as a resource for contemporary theoretical reflections on love and ethics.

The Logic of Sortals: A Conceptualist Approach (Synthese Library #408)

Sortal concepts are at the center of certain logical discussions and have played a significant role in solutions to particular problems in philosophy. Apart from logic and philosophy, the study of sortal concepts has found its place in specific fields of psychology, such as the theory of infant cognitive development and the theory of human perception. In this monograph, different formal logics for sortal concepts and sortal-related logical notions (such as sortal identity and first-order sortal quantification) are characterized. Most of these logics are intensional in nature and possess, in addition, a bidimensional character. That is, they simultaneously represent two different logical dimensions. In most cases, the dimensions are those of time and natural necessity, and, in other cases, those of time and epistemic necessity. Another feature of the logics in question concerns second-order quantification over sortal concepts, a logical notion that is also represented in the logics. Some of the logics adopt a constant domain interpretation, others a varying domain interpretation of such quantification. Two of the above bidimensional logics are philosophically grounded on predication sortalism, that is, on the philosophical view that predication necessarily requires sortal concepts. Another bidimensional logic constitutes a logic for complex sortal predicates. These three sorts of logics are among the important novelties of this work since logics with similar features have not been developed up to now, and they might be instrumental for the solution of philosophically significant problems regarding sortal predicates. The book assumes a modern variant of conceptualism as a philosophical background. For this reason, the approach to sortal predicates is in terms of sortal concepts. Concepts, in general, are here understood as intersubjective realizable cognitive capacities. The proper features of sortal concepts are determined by an analysis of the main features of sortal predicates. Posterior to this analysis, the sortal-related logical notions represented in the above logics are discussed. There is also a discussion on the extent to which the set-theoretic formal semantic systems of the book capture different aspects of the conceptualist approach to sortals. These different semantic frameworks are also related to realist and nominalist approaches to sortal predicates, and possible modifications to them are considered that might represent those alternative approaches.

Logic, Syntax, and a Structural View: The Psychology of Trump's Hall of Mirrors

This book presents a new structural approach to the psychology of the person, inspired by Kenneth Colby’s computer-generated simulation, PARRY. The simulation was of a paranoid psychological state, represented in forms of the person's logic and syntax, as these would be evidenced in personal communication. Harwood Fisher uses a Structural View to highlight similarities in the logical form of the linguistic representations of Donald Trump, his avid followers (“Trumpers”), and the paranoid—referred to as “The Trio.” He demonstrates how the Structural View forms a series of logical and schematic patterns, similar to the way that content analysis can bring forth associations meanings, and concepts held in the text. Such comparisons, Fisher argues, can be used to shed light on contingencies for presenting, representing, and judging truth. Specifically, Fisher posits that the major syntactic and logical patterns that were used to produce the computer-generated “paranoid” responses in Colby’s project can be used to analyze Donald Trump’s rhetoric and his followers’ reactions to it. Ultimately, Fisher offers a new kind of structural approach for the philosophy of psychology. This novel work will appeal to students and scholars of social and cognitive psychology, psychology of personality, psychiatric classification, psycholinguistics, rhetoric, and computer science.

Logical Fictions in Medieval Literature and Philosophy

In the twelfth and thirteenth centuries, new ways of storytelling and inventing fictions appeared in the French-speaking areas of Europe. This new art still influences our global culture of fiction. Virginie Greene explores the relationship between fiction and the development of neo-Aristotelian logic during this period through a close examination of seminal literary and philosophical texts by major medieval authors, such as Anselm of Canterbury, Abélard, and Chrétien de Troyes. This study of Old French logical fictions encourages a broader theoretical reflection about fiction as a universal human trait and a defining element of the history of Western philosophy and literature. Additional close readings of classical Greek philosophers Plato and Aristotle, and modern analytic philosophy including the work of Bertrand Russell and Rudolf Carnap, demonstrate peculiar traits of Western rationalism and expose its ambivalent relationship to fiction.

Logical Form: Between Logic and Natural Language (Synthese Library #393)

Logical form has always been a prime concern for philosophers belonging to the analytic tradition. For at least one century, the study of logical form has been widely adopted as a method of investigation, relying on its capacity to reveal the structure of thoughts or the constitution of facts. This book focuses on the very idea of logical form, which is directly relevant to any principled reflection on that method. Its central thesis is that there is no such thing as a correct answer to the question of what is logical form: two significantly different notions of logical form are needed to fulfill two major theoretical roles that pertain respectively to logic and to semantics. This thesis has a negative and a positive side. The negative side is that a deeply rooted presumption about logical form turns out to be overly optimistic: there is no unique notion of logical form that can play both roles. The positive side is that the distinction between two notions of logical form, once properly spelled out, sheds light on some fundamental issues concerning the relation between logic and language.

London and the Making of Provincial Literature: Aesthetics and the Transatlantic Book Trade, 1800-1850 (Material Texts)

In the early nineteenth century, London publishers dominated the transatlantic book trade. No one felt this more keenly than authors from Ireland, Scotland, and the United States who struggled to establish their own national literary traditions while publishing in the English metropolis. Authors such as Maria Edgeworth, Sydney Owenson, Walter Scott, Washington Irving, and James Fenimore Cooper devised a range of strategies to transcend the national rivalries of the literary field. By writing prefaces and footnotes addressed to a foreign audience, revising texts specifically for London markets, and celebrating national particularity, provincial authors appealed to English readers with idealistic stories of cross-cultural communion. From within the messy and uneven marketplace for books, Joseph Rezek argues, provincial authors sought to exalt and purify literary exchange. In so doing, they helped shape the Romantic-era belief that literature inhabits an autonomous sphere in society.London and the Making of Provincial Literature tells an ambitious story about the mutual entanglement of the history of books and the history of aesthetics in the first three decades of the nineteenth century. Situated between local literary scenes and a distant cultural capital, enterprising provincial authors and publishers worked to maximize success in London and to burnish their reputations and build their industry at home. This can be determined only by the process of developing, which requires a dark room and other apparatus not always at hand; and so much depends upon the process that it might be well if it could always be left to some one who makes a specialty of it, as in the case of the real amateur photographer. Then one's faulty impressions might be so treated as to yield a pictorial result of interest, or frankly thrown away if they showed hopeless to the instructed eye. Otherwise, one must do one's own developing, and trust the result, whatever it is, to the imaginative kindness of the reader, who will surely, if he is the right sort of reader, be able to sharpen the blurred details, to soften the harsh lights, and blend the shadows in a subordination giving due relief to the best meaning of the print. This is what I fancy myself to be doing now, and if any one shall say that my little pictures are superficial, I shall not be able to gainsay him. I can only answer that most pictures represent the surfaces of things.
