Justification and the Truth-Connection
by Clayton LittlejohnThe internalism-externalism debate is one of the oldest debates in epistemology. Internalists assert that the justification of our beliefs can only depend on facts internal to us, while externalists insist that justification can depend on additional, for example environmental, factors. In this book Clayton Littlejohn proposes and defends a new strategy for resolving this debate. Focussing on the connections between practical and theoretical reason, he explores the question of whether the priority of the good to the right (in ethics) might be used to defend an epistemological version of consequentialism, and proceeds to formulate a new 'deontological externalist' view. His discussion is rich with insights and will be valuable for a wide range of readers in epistemology, ethics and practical reason.
Justified and Philosophy: Shoot First, Think Later
by Robert Arp Rod CarvethThe sharp-shooting authors in Justified and Philosophy take aim at many of the same philosophical problems that the Justified TV series grapples with. For instance, is Tim Olyphant's character, Deputy U.S. Marshal Raylan Givens, morally justified in using his Wild-Wild-West-style vigilante tactics to clean up Harlan County, Kentucky?

After all, the meth dealers, thieves, murderers, and other low-life scumbags all deserve what's coming to them, right? Not so fast, Quick-Draw McGraw! What about the law? What about a thorough and complete investigation of matters before dispensing so-called "justice"? What about the idea of the punishment fitting the crime?Deputy Marshal Givens wears a white hat and fights the "bad guys" so he must be a "good guy," right? His opponents are violent drug dealers, white supremacists, and thieves. Givens carries a badge, but when he shoots or kills people, is it always justified? What other choice does he have? Would any other method be as effective in rural eastern Kentucky where criminal activity is one of the few viable options for making a living? The coal-mining culture of Harlan County, Kentucky is an important backdrop to Justified, and the issues surrounding the coal industry are addressed in some chapters. Some of them include health problems like black lung, the dissolution of communities, the reduction in employment alternatives, the destruction of the environment with mountain-top removal and fracking, and the increase in crime and poverty. If Boyd Crowder robs the coal company responsible for exploiting his community, is that justified? The relationship between Boyd and Raylan dates back to a childhood friendship. Then when they older, they worked in the mines together. One chapter explores the character and motivation of both men and argues that each follows a different moral compass. Another chapter discusses the importance of family to the character of Mags Bennett and how that guides her actions and sense of duty. Another topic of discussion is whether the end justifies the means when Boyd and his gang destroy a meth lab and end up killing one of the meth cookers.Other chapters delve into a variety of fascinating philosophical themes that emerge in this modern-day cowboy show.
Justifying Emotions: Pride and Jealousy (Routledge Studies in Ethics and Moral Theory)
by Kristjan KristjanssonThe two central emotions of pride and jealousy have long been held to have no role in moral judgements, and have been a source of controversy in both ethics and moral psychology. Kristjan Kristjansson challenges this common view and argues that emotions are central to moral excellence and that both pride and jealousy are indeed ingredients of a well-rounded virtuous life.
Justifying Intellectual Property
by Robert P. MergesWhy should a property interest exist in an intangible item? In recent years, arguments over intellectual property have often divided proponents—who emphasize the importance of providing incentives for producers of creative works— from skeptics who emphasize the need for free and open access to knowledge. In a wide-ranging and ambitious analysis, Robert P. Merges establishes a sophisticated rationale for the most vital form of modern property: IP rights. His insightful new book answers the many critics who contend that these rights are inefficient, unfair, and theoretically incoherent. But Merges’ vigorous defense of IP is also a call for appropriate legal constraints and boundaries: IP rights are real, but they come with real limits. Drawing on Kant, Locke, and Rawls as well as contemporary scholars, Merges crafts an original theory to explain why IP rights make sense as a reward for effort and as a way to encourage individuals to strive. He also provides a novel explanation of why awarding IP rights to creative people is fair for everyone else in society, by contributing to a just distribution of resources. Merges argues convincingly that IP rights are based on a solid ethical foundation, and—when subject to fair limits—these rights are an indispensable part of a well-functioning society.
Justifying New Labour Policy
by Judi AtkinsAn original combination of theoretical innovation and a detailed empirical analysis of the ideas, language and policy of New Labour. Politicians often appeal to moral principles and arguments in their efforts to win support for new policy programmes. Yet the question of how politicians use moral language has until now been neglected by scholars.
Justifying Our Existence
by Graeme NicholsonIn his magnum opus Being in Time (1927), Martin Heidegger (1889-1976) argued that individuals have assumed that their existence is "a given," when in actual fact they simply have the ability to be. Justifying Our Existence examines the ways in which human beings attempt to calm their existential concerns by magnifying and proving their existence through phenomena such as self-righteousness, careerism, nationalism, and religion. Using remarkably accessible and concise writing, Graeme Nicholson provides a close reading of Heidegger's methods to indicate how his work has a practical application for existential concerns. Justifying Our Existence shows how phenomenology can be used to foreground existence, while also providing startling insights into human behaviour, the motivation behind many of our social systems, as well as one of the twentieth century's most important philosophers.
Justifying Violent Protest: Law and Morality in Democratic States
by James Greenwood-ReevesThis book presents a radical, but compelling, argument that liberal democracies must be able accommodate violent protest. We often think of violent protest as being alien to liberal democracy, an extraordinary occurrence within our peaceful societies. Yet this is simply untrue. Violent protest is a frequent and normal part of democratic life. The real question is: should it be? Can rebellion or riot against government ever be morally justifiable in our society? By framing state demands for obedience as "legitimacy claims," or moral arguments, states who make illogical and unjust laws make weaker arguments for obedience. This in turn gives citizens stronger moral reasons to disobey. Violence can act as moral dialogue – with expressive and instrumental value in denouncing unjust laws – and can have just as important a role in democracy as peaceful protest. This book examines the activism of Hong Kong pro-democracy protesters, Extinction Rebellion, Black Lives Matter, and many other groups internationally, in order to demonstrate that not only can violent protest be acceptable; in times of grave injustice, it is unavoidable. This book will appeal to a broad range of academics, in legal and political theory, sociolegal studies, criminology, history, and philosophy, as well as others with interests in contemporary forms of protest.
Justifying War
by David Welch Jo FoxA new assessment of the debates about Just War in the twentieth and twenty-first centuries, from the imperial wars of the nineteenth century through the age of total war, the evolution of human rights discourse and international law, to proportionality during the Cold War and the redefinition of authority with the ascendancy of terror groups.
Juárez Girls Rising: Transformative Education in Times of Dystopia
by Claudia G. Cervantes-SoonWorking-class girls in Ciudad Juárez grow up in a context marked by violence against women, the devastating effects of drug cartel wars, unresponsive and abusive authorities, and predatory U.S. capitalism: under constantly precarious conditions, these girls are often struggling to shape their lives and realize their aspirations. Juárez native Claudia G. Cervantes-Soon explores the vital role that transformative secondary education can play in promoting self-empowerment and a spirit of resistance to the violence and social injustice these girls encounter.Bringing together the voices of ten female students at Preparatoria Altavista, an innovative urban high school founded in 1968 on social justice principles, Cervantes-Soon offers a nuanced analysis of how students and their teachers together enact a transformative educational philosophy that promotes learning, self-authorship, and hope. Altavista&’s curriculum is guided by the concept of autogestión, a holistic and dialectical approach to individual and collective identity formation rooted in the students&’ experiences and a critical understanding of their social realities. Through its sensitive ethnography, this book shows how female students actively construct their own meaning of autogestión by making choices that they consider liberating and empowering.Juárez Girls Rising provides an alternative narrative to popular and often simplistic, sensationalizing, and stigmatizing discourses about those living in this urban borderland. By merging the story of Preparatoria Altavista with the voices of its students, this singular book provides a window into the possibilities and complexities of coming of age during a dystopic era in which youth hold on to their critical hope and cultivate their wisdom even as the options for the future appear to crumble before their eyes.

Kabbalah and Catastrophe: Historical Memory in Premodern Jewish Mysticism (Stanford Studies in Jewish Mysticism)
by Hartley LachterWhile premodern kabbalistic texts were not chronicles of historical events, they provided elaborate models for understanding the secret divine plan guiding human affairs. Hartley Lachter analyzes innovative kabbalistic doctrines, such as the idea of reincarnation and the notion of multiple successive universes, through which Jewish mystics sought to demonstrate that the misfortunes of Jewish history were in fact necessary steps toward redemption. Lachter argues that these works, mostly composed between the early 14th century and the generation affected by the Spanish expulsion in the early 16th century, enabled Jewish readers to make sense of the troubling misfortunes of their own time. Kabbalah and Catastrophe uncovers the remarkable variety of ways that kabbalists deployed esoteric tradition to argue that God had not abandoned the Jews to the inscrutable forces of history. Instead, they suggested to readers that Jews are history's primary actors, and that despite their small numbers and lack of military power, Jews nonetheless secretly push history forward. For scholars of Jewish mysticism and medieval Jewish history, Lachter articulates how premodern mystical texts can be crucial sources of insight into how Jews understood the meaning of history.

Kafka's Monkey and Other Phantoms of Africa (World Philosophies)
by Seloua Luste BoulbinaEven though many of France’s former colonies became independent over fifty years ago, the concept of "colony" and who was affected by colonialism remain problematic in French culture today. Seloua Luste Boulbina, an Algerian-French philosopher and political theorist, shows how the colony’s structures persist in the subjectivity, sexuality, and bodily experience of human beings who were once brought together through force. This text, which combines two works by Luste Boulbina, shows how France and its former colonies are haunted by power relations that are supposedly old history, but whose effects on knowledge, imagination, emotional habits, and public controversies have persisted vividly into the present. Luste Boulbina draws on the work of Michel Foucault, Frantz Fanon, and Édouard Glissant to build a challenging, original, and intercultural philosophy that responds to blind spots of inherited political and social culture. Kafka's Monkey and Other Phantoms of Africa offers unique insights into how issues of migration, religious and ethnic identity, and postcolonial history affect contemporary France and beyond.
