American Smuggling as White Collar Crime
by Lawrence KarsonWhen Edwin Sutherland introduced the concept of white-collar crime, he referred to the respectable businessmen of his day who had, in the course of their occupations, violated the law whenever it was advantageous to do so. Yet since the founding of the American Republic, numerous otherwise respectable individuals had been involved in white-collar criminality. Using organized smuggling as an exemplar, this narrative history of American smuggling establishes that white-collar crime has always been an integral part of American history when conditions were favorable to violating the law. This dark side of the American Dream originally exposed itself in colonial times with elite merchants of communities such as Boston trafficking contraband into the colonies. It again came to the forefront during the Embargo of 1809 and continued through the War of 1812, the Civil War, nineteenth century filibustering, the Mexican Revolution and Prohibition. The author also shows that the years of illegal opium trade with China by American merchants served as precursor to the later smuggling of opium into the United States. The author confirms that each period of smuggling was a link in the continuing chain of white-collar crime in the 150 years prior to Sutherland’s assertion of corporate criminality.

Ambiguity in EU Law
by Sofiya KartalovaAmbiguity – an expression or utterance giving rise to at least two mutually exclusive interpretations – has been traditionally regarded as an ever-present, and therefore trivial, feature of EU law, alongside other forms of linguistic indeterminacy. At the same time, ambiguity has been condemned as a perilous defect in the legal text, since it is commonly assumed that the Court of Justice of the EU (CJEU) would necessarily exploit it to engage in judicial activism. In contrast, more recent theories present ambiguity as a means of promoting greater acceptability and coherence, while trusting the CJEU’s willingness to exert judicial restraint for the benefit of judicial co-operation. This ground-breaking work challenges some of the theoretical assumptions about ambiguity in EU law and puts forward a more accurate and complete theory about the CJEU’s strategic use of ambiguity. Ambiguity is here transformed from an underestimated or misunderstood detail of undetermined significance to a desirable systemic feature of the EU legal order with concrete properties and impact. Ambiguity as the implicit basis of the CJEU’s decision-making is shown to be strategically valuable for the implementation of the authority of EU law at some of the most pivotal moments in the evolution of the EU legal order. This interdisciplinary investigation presents in-depth linguistic and legal analysis of ambiguity found in the text of key provisions of EU Treaties and in the language of some of the CJEU’s leading preliminary rulings in the area of fundamental rights, freedom of movement and EU citizenship. The Historical Literature of the Jack Cade Rebellion

KaufmanAccounts of Jack Cade's 1450 Rebellion-an uprising of some 30,000 middle-class citizens, protesting Henry VI's policies, and resulting in hundreds of deaths as well as the leaders' execution-form the dominant entry in a group of quasi-historical documents referred to as the London chronicles of the Fifteenth Century. However, each chronicle is inherently different and highly subjective. In the first study of the primary documents related to the Cade Rebellion, Alexander L. Kaufman shows that the chroniclers produced multiple representations of the event rather than a single, unified narrative. Aided by contemporary theories of historiography and historical representation, Kaufman scrutinizes the differing representations and distinguishes the writers' objectiveness, their underrated literary skills, and their ideological positions on the rebellion and fifteenth-century politics. He demonstrates how the use of figurative language is related to writing about trauma, and how descriptions of Cade's procession through London are a violent parody of midsummer festivals. In an exploration of authenticity in the descriptions of Cade, Kaufman also examines the characterization and plot devices that push Cade towards the realm of myth, showing that representations of Cade are influenced by popular fifteenth-century stories of Robin Hood.
Iran's Nuclear Diplomacy

The Enlightened Shareholder Value Principle and Corporate Governance

Keay goes on to compare ESV with the constituency statutes that apply in the US in order to determine whether anything can be learnt from the American experience.
