Adjudicating New Governance

New modes of governance have produced a plethora of instruments and actors at various levels that present a challenge to more traditional forms of command-and-control regulation. In this respect, it is commonly maintained that new governance generally – and political experimentation more broadly – weakens the power of the courts, producing a legitimacy problem for new forms of governance and, perhaps more fundamentally, for law itself. Focusing on the European Union, this book offers a new account of the role of the courts in new governance. Connecting new governance with the conception of deliberative democracy, this book demonstrates how the role of courts has been transformed by the legal and political experimentation currently taking place in the European Union. Drawing on a series of case studies, it is argued that, although deliberations in governance frameworks provide little by way of hard, binding law, these collaborative frameworks nevertheless condition judicial decision making. With far-reaching implications for how we understand the justiciability of ‘soft law’, participation rights, the legitimacy of governance measures, and the role of courts beyond the nation-state, this book argues that, far from undermining the power of the courts, governance regimes assist their functioning. Its analysis will therefore be of considerable interest for lawyers, political scientists and anyone interested in the transformation of the judiciary in the era of new governance.
History Education and Post-Conflict Reconciliation

Conversion To Islam
by Ali KoseFirst Published in 1996. Religious conversion is an immensely complex phenomenon. The term comprises such diverse experiences as increased devotion within the same religious structure, a shift from no religious commitment to a devout religious life, or a change from one religion to another. This study focuses on the conversion experiences of 70 native British converts to Islam. It addresses the following questions - why do people become Muslims, what are the backgrounds of the converts, what are the patterns of conversion to Islam, and how far are existing conversion theories applicable to the group under study. The full range of social and psychological forces at work in the conversion experience are examined with reference to the converts, whose whole life history - childhood, adolescent experiences and the conversion process itself - were examined in detail. Chapter 1 deals with the history and present situation of both life-long Muslims and converts living in Britain. Chapter 2 focuses on childhood and adolescent experiences reviewing the psychological and sociological theories of conversion and attempts to find out how far these theories are applicable to the converts to Islam. Chapter 3 examines the backgrounds of the converts regarding religion. It then analyzes the immediate antecedents of the conversion as well as the conversion process, focussing on version motifs. A conversion process model is also developed in this chapter. Chapter 4 looks at the post-conversion period to find out what changes the converts underwent. It also examines the relationship between converts, their parents and society at large. Chapter 5 reveals the findings on conversion through Sufism. Comparisons between conversion through Sufism and through new religious movements in the West are also made. This study should be an important addition to the study of religious conversion, as conversion to Islam either from outside or within Islam is widely neglected in the literature.
CyberPhysical Systems

European Civil War Films

Exploring a range of films about the Spanish, Irish, former Yugoslavia, and Greek civil wars, this comparative and interdisciplinary study engages with contemporary debates in cultural memory and investigates the ways in which cinematic postmemory is problematic. Many of the films present an idealized past that glosses over the reality of these civil wars, at times producing a nostalgic discourse of loss and longing. Historical Memory in Greece, 1821–1930
by Christina KoulouriThis book presents a social and cultural history of collective memory in modern Greece during the first century of state independence, contributing to the debate over the relationship between memory and identity. It discusses how modern Greek society commemorated its distant and recent pasts, both real and imagined, namely antiquity, Byzantium, the Greek Revolution and the Asia Minor Catastrophe; how cultural memory was shaped by the various war experiences (victory, defeat, mass death and mourning, refugeedom); and how memory politics became arenas of social and political strife. Historical painting, monuments, historical pageantry, tableaux vivants, national anniversaries, performances of ancient drama and revivals of ancient games are analyzed as instances where the past was visualized, represented, performed and "consumed". As more and more social groups claim the "right to remember", public discourse and polemics have arisen at the same time that traumatic memory has become a field of international academic research. In the arena of public history, historical memory is being constructed through the sentimental, irrational reception of mythological narratives told through images.
Face[t]s of First Language Loss
