Unlike learning, which presents the actualization of a student’s "potential" in recognizable and measurable forms, study emphasizes the experience of potentiality, freed from predetermined outcomes. Studying suspends and interrupts the conventional logic of learning, opening up a new space and time for educational freedom to emerge. Drawing upon the work of Italian philosopher and critical theorist Giorgio Agamben, Lewis provides a conceptually and poetically rich account of the interconnections between potentiality, freedom, and study. Decolonising Indigenous Child Welfare

It has been influenced by Indigenous peoples’ human rights advocacy at national and international levels, by claims to self-determination and by the globalisation of Indigenous children’s organisations. Thus far, this reform has taken place with little attention from academic and non-Indigenous communities; now, Decolonising Indigenous Child Welfare: Comparative Perspectives considers these developments and, evaluating law reform with respect to Indigenous child welfare, asks whether the pluralisation of responses to their welfare and well-being, within a cross-cultural post-colonial context, can improve the lives of Indigenous children. The legislative frameworks for the delivery of child welfare services to Indigenous children are assessed in terms of the degree of self-determination which they afford Indigenous communities. The book draws upon interdisciplinary research and the author’s experience collaborating with the peak Australian Indigenous children’s organisation for over a decade to provide a thorough examination of this international issue. Economy, Emotion, and Ethics in Chinese Cinema

Reconceptualizing Deterrence

The work argues that many of the problems encountered in the development of deterrence theory lay in the fact that it was developed during the Cold War, when the immediate problem it had to address was how to prevent catastrophic nuclear wars. The logic of nuclear deterrence compelled a preoccupation with the problem of stability over credibility; however, because the logic of conventional deterrence is different, the solution of the tension between credibility and stability is achieved by deference to credibility, due to the requirements of reputation and costly signaling. This book aims to narrow the gap between theory and evidence. It explores how a reconceptualization of the theory as a process that culminates in the internalization of deterrence within enduring rivalries is better suited to account for its final success: a finding that has eluded deterrence theorists for long. International Law and Civil Wars
by Eliav LieblichThis book examines the international law of forcible intervention in civil wars, in particular the role of party-consent in affecting the legality of such intervention. In modern international law, it is a near consensus that no state can use force against another – the main exceptions being self-defence and actions mandated by a UN Security Council resolution. However, one more potential exception exists: forcible intervention undertaken upon the invitation or consent of a government, seeking assistance in confronting armed opposition groups within its territory. Although the latter exception is of increasing importance, the numerous questions it raises have received scant attention in the current body of literature. This volume fills this gap by analyzing the consent-exception in a wide context, and attempting to delineate its limits, including cases in which government consent power is not only negated, but might be transferred to opposition groups. The book also discusses the concept of consensual intervention in contemporary international law, in juxtaposition to traditional legal doctrines. It traces the development of law in this context by drawing from historical examples such as the Spanish Civil War, as well as recent cases such those of the Democratic Republic of the Congo, Somalia, Libya, and Syria. This book will be of much interest to students of international law, civil wars, the Responsibility to Protect, war and conflict studies, and IR in general.

Two (Cohen and Gilat) consider the positive and forward-thinking aspects of such halakhic creativity. The third (Radzyner) examines tendentious invocation of new halakhic arguments to advance an extraneous interest. Cohen explores positive creativity and surveys the innovative midrashic exegeses of R. Meir Simha Hakohen of Dvinsk, demonstrating his willingness to base rulings intended for implementation on such exegesis. Gilat examines exegetical creativity as to the laws of capital offenses. Midrashic argumentation enables the rabbinical authorities to set aside the literal sense of the harsh biblical laws, and implement more suitable penological policies. On the other hand, Radzyner’s article on tendentious innovation focuses on a situation where novel arguments were advanced in the context of a power struggle, namely, Israeli rabbinical court efforts to preserve jurisdiction. Two articles discuss contemporary dilemmas. Spira & Wainberg consider the hypothetical scenario of triage of an HIV vaccine, analyzing both the talmudic sources for resolving issues related to allocating scarce resources, and recent responsa. Warburg discusses the status of civil marriage and cohabitation vis-à-vis payment of spousal maintenance: can rabbinical courts order such payment? Schreiber’s article addresses the question of whether privacy is a core value in talmudic law: does it indeed uphold a ‘right to privacy,’ as recent scholars have claimed? The volume concludes with a review of Yuval Sinai’s Application of Jewish Law in the Israeli Courts (Hebrew).

Food Security, Biological Diversity and Intellectual Property Rights

The Referential Mechanism of Proper Names
by Jincai LiEach of us bears a unique name given to us at birth. When people use your name, they typically refer to you. But what is the linkage that ties a name to a person and hence allows it to refer? Li’s book approaches this question of reference empirically through the medium of referential intuitions. Building on the literature on philosophical and linguistic intuitions, she proposes a linguistic-competence-based account of referential intuitions. Subsequently, using a series of novel experiments, she investigates the variation of referential intuitions across different cultures, as well as the developmental trajectory and the underlying causes of the observed cultural differences. What she finds is that the cultural patterns of referential intuitions are already in place around age seven, and the differences are largely attributable to the distinct perspective taking strategies favoured by easterners and westerners, rather than the moral valence of actions involved in the experimental materials. These results are taken to better support referential pluralism (in particular, the ambiguous view) than referential monism. By undertaking this fascinating research, Li’s book provides new insights into the cognitive mechanisms underlying people’s referential usage of names. It will be valuable to students and scholars of linguistics, philosophy of language and experimental philosophy, and in particular, to those who research into semantic intuitions and theories of reference.

Cambodia and the Politics of Aesthetics

Citizenship Education and Migrant Youth in China

However, their inclusion in urban public schools is a surprisingly slow process, and youth identities in newly industrialized countries remain largely neglected. Faced with monetary and institutional barriers, the majority of migrant youth attend low-quality or underperforming migrant schools, without access to the free compulsory education enjoyed by their urban counterparts. As a result, China’s citizen-building scheme and the sustainability of its labor-intensive economy have greatly impacted global economic restructuring. Using thorough ethnographic research, this volume examines the consequences of urban schooling and citizenship education through which school and social processes contribute to the production of unequal class relations. It explores the nexus of citizenship education and identity-forming practices of poor migrant youth in an attempt to foresee the new class formation in Chinese society. This volume opens up the "black box" of citizenship education in China and examines the effect of school and societal forces on social mobility and life trajectories.
