Humanitarian Countermeasures

“[I]f humanitarian intervention is, indeed, an unacceptable assault on sovereignty, how should we respond to a Rwanda, to a Srebrenica—to gross and systematic violations of human rights that offend every precept of our common humanity?” – Kofi Annan This question asked by Kofi Annan over twenty years ago has not lost its relevance since, as for instance demonstrated by the paralysis of the Security Council in the face of the continued use of chemical weapons by the Syrian regime against its own population. The present work addresses the question of whether the unilateral use of force by states for humanitarian purposes, hence without a Security Council authorization, could be justified via the concept of 'humanitarian countermeasures’. In this context, humanitarian countermeasures are derived from the notion of countermeasures, which stems from the law of state responsibility as conceived in Art. 49 et seq. DARS and traditionally only refers to peaceful, bilateral measures. The core of the study is to open up countermeasures to humanitarian military action, discuss the legal feasibility of such an approach, while effectively containing the potential for abuse by establishing a legal framework. In a final step, concrete conditions for humanitarian countermeasures are defined, which can guide a reinterpretation of countermeasures and the further development of customary law. About the author Cathrine Crämer studied law at the Humboldt European Law School at the HU Berlin, the Université Paris II Panthéon Assas (Maîtrise en Droit in Private International Law) and at King's College London (LL.M. in Transnational Law). She obtained her doctorate at the LMU Munich, where she worked as a research assistant and taught public international law. Cathrine Crämer is currently a legal trainee at the Permanent Mission of Germany to the United Nations in New York.

The Incoherence of Human Rights in International Law: Absence, Emergence and Limitations (ISSN)

Incoherence is a term that is all too often associated with the public international law regime. To a great extent, its incoherence is arguably a natural consequence of the fragmented nature of both the development and overall scope of the discipline. Despite significant achievements since the Universal Declaration of Human Rights (1948), a coherent human rights regime that is properly integrated with other branches of public international law is still lacking. This book explores this incoherent approach to human rights, including specific challenges that arise as a result of the creation and regulation of legal relationships between parties (state and non-state) that sit outside of the human rights framework, with a view to considering how it may be remedied. Divided into three parts, the collection provides a critical exploration of various challenges and barriers related to the absence of human rights in some instances, contemporary emergence of rights, and a lack of rights fulfilment in others. These three situations are considered within the wider context of, and difficulties facing, a human rights-based approach to international law. Each of the three parts aligns with one of the three prime responsibilities and duties of states in respect of international human rights: to promote, to protect and to fulfil. Performing the Nonhuman: Towards a Theatre of Transformation (ISSN)

This book radically reimagines theatre/performance pedagogy and dramaturgy in response to the accelerating climate crisis.This text is founded upon the principle that the theatre is the most anthropocentric of all the arts: the means of its representation, the human figure, is identical with its conventional object, the human narrative, broadly considered. In order to respond ethically to the climate crisis, it must expand its range to include performing as/in response to the nonhuman. Conrad Alexandrowicz concisely explores theoretical approaches to the other‑than‑human, found in the work of, among others, Jane Bennett, Timothy Morton, Rosi Braidotti, and Cary Wolfe. The implications of this move are far‑reaching and commence with displacing realism from its traditional position of dominance. The practices of 20th century physical theatre visionaries such as Tadeusz Kantor, Jacques Lecoq, and Jerzy Grotowski are revisited and reconsidered for their applicability to forms of theatre that might serve the needs of establishing storytelling deriving from nonhuman phenomena. This logically leads to the matter of responding appropriately to Indigenous ways of knowing and being. The work finds guidance in Indigenous, pre‑scientific ways of knowing and being, such as those articulated by Robin Wall Kimmerer (Braiding Sweetgrass, 2013). In contemplating our kinship with vegetative life, the work finds inspiration in the latest research into the ways tree communities communicate, collaborate, and share resources, including the work of Suzanne Simard (Finding the Mother Tree, 2021). It next imagines transformations in how theatre is situated, delivered, and received and considers the ways in which the performer/spectator binary may have to be reconfigured, with particular reference to Grotowski’s experiments in participatory theatre. It poses an even more provocative question: is such theorized performance work pointing in the direction of some re‑imagined version of ritual and ceremony that may find antecedents in pre‑Christian European belief and practice? Finally, it locates such eco‑theatre in the realm of healing: climate anxiety, depression, and grief on the part of instructors, students, and artists will require us to consider and activate the healing power of the art form; perhaps, the core purpose of all the arts will shift to support the need to generate solace in times of fear, anger, and uncertainty.This book is intended for instructors, both scholars and performance pedagogues, in theatre and performance studies, as well as graduate and undergraduate students in these areas.

Farming Systems and Sustainable Agriculture in the Himalaya (Sustainable Development Goals Series)

The farming system in the Central Himalayan Region is distinctive and unique, mainly focusing on the cultivation of traditional subsistence cereal crops. The agrobiodiversity in this region is rich, with the Central Himalaya growing numerous cultivars and crop races. The practice of cultivating many crops or cultivars in a single field is known as the 'Barahnaja System.' Another peculiar system is the Sar/Sari system, where different crops grow in the two Sars during the same seasons, with one Sar left fallow for six months while the other grows crops. This century-old farming method involves plowing fields with oxen and using organic manure to enhance crop production and productivity. However, recent changes have been observed in the farming systems. The area under traditionally growing millets is declining. In river valleys and middle altitudes, there is a recent trend towards cultivating paddy and wheat. Unfortunately, the cultivation of temperate fruits – apple and citrus has seen a decline in terms of area, production, and productivity. Various factors are influ encing farming systems in the Central Himalaya, such as high climate variability and change, decreasing crop production and productivity, evolving food habits, and out-migration. High Energy Efficiency Neural Network Processor with Combined Digital and Computing-in-Memory Architecture (Springer Theses)

Neural network (NN) algorithms are driving the rapid development of modern artificial intelligence (AI). The energy-efficient NN processor has become an urgent requirement for the practical NN applications on widespread low-power AI devices. To address this challenge, this dissertation investigates pure-digital and digital computing-in-memory (digital-CIM) solutions and carries out four major studies. For pure-digital NN processors, this book analyses the insufficient data reuse in conventional architectures and proposes a kernel-optimized NN processor. This dissertation adopts a structural frequency-domain compression algorithm, named CirCNN. The fabricated processor shows 8.1x/4.2x area/energy efficiency compared to the state-of-the-art NN processor. For digital-CIM NN processors, this dissertation combines the flexibility of digital circuits with the high energy efficiency of CIM. The fabricated CIM processor validates the sparsity improvement of the CIM architecture for the first time. This dissertation further designs a processor that considers the weight updating problem on the CIM architecture for the first time. This dissertation demonstrates that the combination of digital and CIM circuits is a promising technical route for an energy-efficient NN processor, which can promote the large-scale application of low-power AI devices.

This text gives a comprehensive, largely self-contained treatment of multivariate heavy tail analysis. Emphasizing regular variation of measures means theory can be presented systematically and without regard to dimension. Tools are developed that allow a flexible definition of "extreme" in higher dimensions and permit different heavy tails to coexist on the same state space leading to "hidden regular variation" and "steroidal regular variation". This emphasizes when estimating risks, it is important to choose the appropriate heavy tail. Theoretical foundations lead naturally to statistical techniques; examples are drawn from risk estimation, finance, climatology and network analysis. Treatments target a broad audience in insurance, finance, data analysis, network science and probability modeling. The prerequisites are modest knowledge of analysis and familiarity with the definition of a measure; regular variation of functions is reviewed but is not a focal point.
