Money as Organization, Gustavo Del Vecchio's Theory (Modern Heterodox ECON #1)
by Gianfranco TussetBetween 1909-17, Gustavo Del Vecchio developed a ‘theory of circulation’. In a series of articles he set out his thoughts on the utility and value of money, credit, discount rates, banking and international payments. Tusset re-evaluates Del Vecchio’s theory, concluding that money represents a technology which organizes both economy and society.
Debating Legal Pluralism and Constitutionalism: New Trajectories for Legal Theory in the Global Age (Ius Comparatum - Global Studies in Comparative Law #41)
by Guillaume TusseauThe book gathers the general report and the national reports presented at the XXth General Congress of the IACL, in Fukuoka (Japan), on the topic “Debating legal pluralism and constitutionalism: new trajectories for legal theory in the global age”. Discussing the major contemporary changes occurring in and problems faced by domestic legal systems in the global age, the book describes how and to what extent these trends affect domestic legal orderings and practices, and challenges the traditional theoretical lenses that are offered to tackle them: constitutionalism and pluralism. Combining comparative law and comparative legal doctrine, and drawing on the national contributions, the general report concludes that most of the classic tools offered by legal doctrine are not appropriate to address most of today’s practical and theoretical global legal challenges, and as such, the book also offers new intellectual tools for the global age.
The Legal Philosophy and Influence of Jeremy Bentham: Essays on 'Of the Limits of the Penal Branch of Jurisprudence' (Routledge Research in Constitutional Law)
by Guillaume TusseauGathering together an impressive array of legal scholars from around the world, this book features essays on Jeremy Bentham’s major legal theoretical treatise, Of the Limits of the Penal Branch of Jurisprudence, reassessing Bentham’s theories of law as well as his impact on jurisprudence. While offering a suggestive picture of contemporary Bentham studies, the book provides a thorough examination of concepts such as legal discourse, legal norms, legal system, and subjective legal positions. The book compares Bentham’s approach with other landmark theories and the works of major legal philosophers including Austin, Hart and Kelsen, and explores Bentham’s treatise through major trends in contemporary legal thought, such as the imperative theory of law, deontic logic, Scandinavian and American legal realisms, the pure theory of law, and critical legal thought. Resisting any apologetic stance, the book elucidates how consistent with Bentham’s all-encompassing project of utilitarian reform ‘Limits’ turns out to be, and how this sheds light on contemporary modes of governance. The book will be great use and interest to scholars and students of contemporary jurisprudence, legal theory, 19th century philosophy, and public law.

The Fixer: My Adventures Saving Startups from Death by Politics
by Bradley TuskThe famed political advisor to Uber, FanDuel, Lemonade, Tesla and other startups reveals what really happens at the intersection of politics, tech and businessMost new startups today are in highly regulated industries with strong incumbents - transportation, hotels, drones, energy, gaming, education, health care, cannabis, finance, liquor, insurance. The more startups try to snatch a piece of the establishment's pie, the more they risk running into a political wall. That's where Bradley Tusk comes in.Described as "Silicon Valley's Political Savior" (Fast Company) "Uber's Political Genius" (Vanity Fair) and "Silicon Valley's Favorite Fixer" (TechCrunch) Tusk deploys the skills and knowledge he developed working with Chuck Schumer, Michael Bloomberg, Rod Blagojevich, and other political and business legends to help startups fight back. This book goes behind the scenes on how he helped stop the taxi industry from killing Uber in its infancy, how he held insurance companies at bay while startup Lemonade launched in each state, and how he helped online sports betting sites FanDuel and Draft Kings escape the regulatory death grip casinos tried to put on them.As Tusk writes, "Every new company is essentially a tech startup. And when you disrupt someone in any industry, they don't say thank you. They punch you in the nose. These are the lessons startups need to learn to punch back and survive the clutches of politics." Combining a firsthand glimpse behind the curtain with tangible advice for how any new venture can play the political game, THE FIXER is a must-read for aspiring entrepreneurs.
Obvious in Hindsight

But before that happens, the slick and powerful political consultants campaigning to get the new tech adopted will have to manipulate political operatives to their advantage while overcoming fierce opposition from groups hostile to the idea, from the strategically aligned taxi cab and rideshare companies to the squawking, costumed Audubon Society, the socialists, and the Russian mob. This story takes readers on a richly imagined, page-turning journey through multiple cities populated by opposing special interest groups, hucksters, and corrupt power brokers. A riveting and ultimately insightful satire that provides an insider&’s view of how capitalism, politics, and entrepreneurship intersect, Obvious in Hindsight is a timely novel destined to become one of the most entertaining cautionary tales of the millennium.
Vote With Your Phone: Why Mobile Voting Is Our Final Shot at Saving Democracy
by Bradley TuskDemocracy is broken because the way we vote is broken. But there is a solution: Mobile Voting.Gun Control. Abortion. From the halls of Congress, it may seem that Americans are bitterly polarized on the biggest policy issues of the day. But Americans are not as divides as we think, and polls show that most of us largely agree on even the most divisive issues. The problem lies in how we vote. Politics is more extreme because only the most extreme voters turn out in primaries. And with politicians prioritizing reelection above all else, they shun compromise, feed this extremism, and get rewarded for it. If a lot more people vote, the views of the electorate become more mainstream, and our politicians and policies will shift to the center. Mobile voting is the solution. We do just about everything on our phones, and yet we still can't use them to vote. But the technology exists, provides enhanced security over traditional paper ballots, and it could exponentially increase voter turnout by: Allowing Americans to vote from anywhere, on their own scheduleMaking voting more accessible for people who are not well served by mail-in ballots, such as voters with visual impairments and military servicemembers – and their families - overseasProviding more security than traditional paper ballotsIncentivizing younger voters to participate by using technology they're familiar withFrom Bradley Tusk, philanthropist and founder of the Mobile Voting Project, comes a deeply informative and timely analysis of our broken voting system, introducing us to the history, opposition, and potential of voting from our devices. Including essays by Martin Luther King Jr. III and other prominent political figures, Vote with Your Phone shows us that a solution to restoring faith in our representative democracy is right in the palm of our hands.
The Sage's Tao Te Ching, Tenth Anniversary Edition: Ancient Advice for the Second Half of Life
by Hank Tusinski Chungliang Al Huang William MartinThe tenth anniversary edition of William Martin’s free-verse interpretation of the Tao Te Ching, written expressly for those coming into the fullness of their wisdomLao Tzu’s Tao Te Ching, one of the world’s most widely read books of wisdom, reminds its readers that the sage has been venerated in China for thousands of years. In this free-verse interpretation of the Tao, William Martin subtly and powerfully captures the complex emotions connected with growing older. He encourages today’s sages to recognize their inestimable worth in a youth-centric world that often goes astray: “Will I be able to harvest my life in compassion and love for the world? Will I find in my own heart the wisdom for which I long? This question trumps all others for me. I suspect it is the same for you.”
Chokepoints: Global Private Regulation on the Internet
by Natasha TusikovIn January 2012, millions participated in the now-infamous "Internet blackout" against the Stop Online Piracy Act, protesting the power it would have given intellectual property holders over the Internet. However, while SOPA's withdrawal was heralded as a victory for an open Internet, a small group of corporations, tacitly backed by the US and other governments, have implemented much of SOPA via a series of secret, handshake agreements. Drawing on extensive interviews, Natasha Tusikov details the emergence of a global regime in which large Internet firms act as regulators for powerful intellectual property owners, challenging fundamental notions of democratic accountability.

From Black Gold to Frozen Gas: How Qatar Became an Energy Superpower (Center on Global Energy Policy Series)
by Michael D. TusianiToday, Qatar is among the world’s wealthiest countries. Its rich hydrocarbon resources have transformed this small Gulf state into an energy powerhouse, funded its outsized global ambitions, and allowed it to forge an identity separate from those of its large and powerful neighbors.Drawing on Michael D. Tusiani’s firsthand accounts and deep personal experience in the energy sector and Anne-Marie Johnson’s years of reporting, this book explores how Qatar became a major player in the global energy market. It follows the twists and turns of Qatar’s road to riches, from the first interest by British and American oil companies in the 1920s to the decades it took to develop the North field—the world’s largest gas field—following its discovery in 1971 through the country’s emergence as one of the world’s leading exporters of liquefied natural gas (LNG) in the 2000s.From Black Gold to Frozen Gas details the technical, financial, and political challenges involved in getting Qatar’s first LNG projects off the ground. It shows how, despite missteps and setbacks, the foundations of today’s Qatar were laid over many decades. And it chronicles epic rivalries within the ruling Al Thani family, among oil companies, and in the geopolitics of the energy landscape.Part historical analysis, part in-the-room narrative, From Black Gold to Frozen Gas is the definitive account of oil and gas development in Qatar.
The Nasirean Ethics (Routledge Library Editions: Iran)
by Nasir ad-Din TusiThe Nasirean Ethics is the best known ethical digest to be composed in medieval Persia, if not in all mediaeval Islam. It appeared initially in 633/1235 when Tūsī was already a celebrated scholar, scientist, politico-religious propagandist. The work has a special significance as being composed by an outstanding figure at a crucial time in the history he was himself helping to shape: some twenty years later Tūsī was to cross the greatest psychological watershed in Islamic civilization, playing a leading part in the capture of Baghdad and the extinction of the generally acknowledged Caliphate there. In this work the author is primarily concerned with the criteria of human behaviour: first in terms of space and priority allotted, at the individual level, secondly, at the economic level and thirdly at the political level.

Free Speech Beyond Words: The Surprising Reach of the First Amendment
by Mark V. Tushnet Alan K. Chen Joseph BlocherThe Supreme Court has unanimously held that Jackson Pollock’s paintings, Arnold Schöenberg’s music, and Lewis Carroll’s poem “Jabberwocky” are “unquestionably shielded” by the First Amendment. Nonrepresentational art, instrumental music, and nonsense: all receive constitutional coverage under an amendment protecting “the freedom of speech,” even though none involves what we typically think of as speech—the use of words to convey meaning. As a legal matter, the Court’s conclusion is clearly correct, but its premises are murky, and they raise difficult questions about the possibilities and limitations of law and expression. Nonrepresentational art, instrumental music, and nonsense do not employ language in any traditional sense, and sometimes do not even involve the transmission of articulable ideas. How, then, can they be treated as “speech” for constitutional purposes? What does the difficulty of that question suggest for First Amendment law and theory? And can law resolve such inquiries without relying on aesthetics, ethics, and philosophy? Comprehensive and compelling, this book represents a sustained effort to account, constitutionally, for these modes of “speech.” While it is firmly centered in debates about First Amendment issues, it addresses them in a novel way, using subject matter that is uniquely well suited to the task, and whose constitutional salience has been under-explored. Drawing on existing legal doctrine, aesthetics, and analytical philosophy, three celebrated law scholars show us how and why speech beyond words should be fundamental to our understanding of the First Amendment.
The Hughes Court: From Progressivism to Pluralism, 1930 to 1941 (Oliver Wendell Holmes Devise History of the Supreme Court of the United States #11)
by Mark V. TushnetThe Hughes Court: From Progressivism to Pluralism, 1930 to 1941 describes the closing of one era in constitutional jurisprudence and the opening of another. This comprehensive study of the Supreme Court from 1930 to 1941 – when Charles Evans Hughes was Chief Justice – shows how nearly all justices, even the most conservative, accepted the broad premises of a Progressive theory of government and the Constitution. The Progressive view gradually increased its hold throughout the decade, but at its end, interest group pluralism began to influence the law. By 1941, constitutional and public law was discernibly different from what it had been in 1930, but there was no sharp or instantaneous Constitutional Revolution in 1937 despite claims to the contrary. This study supports its conclusions by examining the Court's work in constitutional law, administrative law, the law of justiciability, civil rights and civil liberties, and statutory interpretation.
The NAACP's Legal Strategy against Segregated Education, 1925-1950
by Mark V. TushnetThe NAACP's fight against segregated education--the first public interest litigation campaign--culminated in the 1954 Brown decision. While touching on the general social, political, and economic climate in which the NAACP acted, Mark V. Tushnet emphasizes the internal workings of the organization as revealed in its own documents. He argues that the dedication and the political and legal skills of staff members such as Walter White, Charles Hamilton Houston, and Thurgood Marshall were responsible for the ultimate success of public interest law. This edition contains a new epilogue by the author that addresses general questions of litigation strategy, the persistent question of whether the Brown decision mattered, and the legacy of Brown through the Burger and Rehnquist courts.

Comparative Constitutional Law and Policy: New Frontiers, New Challenges (Comparative Constitutional Law and Policy)
by Mark Tushnet Jackson Vicki C.With contributions from leading scholars in constitutional law, this volume examines how carefully designed and limited doctrines of proportionality can improve judicial decision-making, how it is applied in different jurisdictions, its role on constitutionalism outside the courts, and whether the principle of proportionality actually advances or detracts from democracy. Contributions from some of the seminal thinkers on the development of scholarship on proportionality (e. g. Alexy, Barak, and Beatty) extend their prior work and engage in an important dialogue on the topic. Some offer substantial critiques, others defend the doctrine and offer important clarifications and extensions of their prior work. Throughout, the authors engage not only with case law from around the world but also with existing scholarly treatments of the subject. Mathematical treatments are avoided, making the book accessible to readers from both 'soft' and hard' social science backgrounds.
Comparative Constitutional Law and Policy: Unstable Constitutionalism
by Tushnet, Mark and Khosla, Madhav Mark Tushnet Madhav KhoslaAlthough the field of constitutional law has become increasingly comparative in recent years, its geographic focus has remained limited. South Asia, despite being the site of the world's largest democracy and a vibrant if turbulent constitutionalism, is one of the important neglected regions within the field. This book remedies this lack of attention by providing a detailed examination of constitutional law and practice in five South Asian countries: India, Pakistan, Sri Lanka, Nepal, and Bangladesh. Identifying a common theme of volatile change, it develops the concept of 'unstable constitutionalism', studying the sources of instability alongside reactions and responses to it. By highlighting unique theoretical and practical questions in an underrepresented region, Unstable Constitutionalism constitutes an important step toward truly global constitutional scholarship.
